17 Plaintiff Michael Benanti is appearing pro se and in forma pauperis in this civil rights 18 action. 19 I. INTRODUCTION 20 On August 22, 2025, the Court issued its First Screening Order. (Doc. 44.) The 21 undersigned found Plaintiff failed to state a claim upon which relief could be granted. (Id. at 5- 22 13.) Plaintiff was granted leave to file an amended complaint and provided relevant legal 23 standards. (Id.) Specifically, he was directed to file either a first amended complaint, curing the 24 deficiencies identified in the order, or a notice of voluntary dismissal, within 30 days.
