Plaintiff 19 Crystal Graham is a state prisoner proceeding through counsel on her First Amended Complaint 20 alleging violations of civil and constitutional Rights under 42 U.S.C. § 1983. (Doc. No. 22, 21 “FAC”). Defendant Michael Pallares filed a motion to dismiss pursuant to Federal Rule of Civil 22 Procedure 12(b)(6). (Doc. No. 24). Plaintiff filed an opposition (Doc. No. 29), and Defendant 23 filed a reply (Doc. No. 31). For the reasons set forth below, the undersigned recommends the 24 district court grant in part and deny in part the motion to dismiss. …
