15 Petitioner Hien Vu came to the United States as a refugee from Vietnam nearly thirty-five years ago. In 1997, he was convicted of second degree robbery, an aggravated felony. Based on that conviction, petitioner was ordered removed to Vietnam and was detained by immigration authorities pending his removal. However, immigration authorities were unable to carry out petitioner’s removal because Vietnam had a policy of not accepting the return of its citizens who arrived in the United States before 1995.
