15 16 Petitioner Hien Vu came to the United States as a refugee from Vietnam nearly thirty-five 17 years ago. In 1997, he was convicted of second degree robbery, an aggravated felony.1 Based on 18 that conviction, petitioner was ordered removed to Vietnam and was detained by immigration 19 authorities pending his removal. However, immigration authorities were unable to carry out 20 petitioner’s removal because Vietnam had a policy of not accepting the return of its citizens who 21 arrived in the United States before 1995.
