(ECF No. 40). This Defendant has not filed either an answer or a motion for 29 | summary judgment. Thus, in light of the notice, the case against this Defendant has ended and 21 | is dismissed with prejudice and with the parties to bear their own fees and costs. See Fed. R. 92 | Civ. P. 41(a)()(A)@); Wilson v. City of San Jose, 111 F.3d 688, 692 (9th Cir. 1997). 23 | Accordingly, the Clerk of Court is respectfully directed to terminate Defendant Equifax 74 | Information Services, LLC as a defendant on the docket.
