Currently pending before the court is plaintiff’s motion to reopen 19 this closed case. ECF No. 34. Defendants have not filed an opposition to the motion and the time 20 to do so has expired. For the reasons explained in further detail below, the undersigned 21 recommends granting the motion. 22 I. Factual and Procedural History 23 The instant action was commenced on November 17, 2023 while plaintiff was 24 incarcerated at California State Prison-Sacramento (“CSP-Sac”). ECF No. 1.
