Malik LLC (“GPM”) brought this action for fraud, 18 conversion, and elder abuse against defendants Farhan and John Malik.1 This action proceeds on 19 the Third Amended Complaint (TAC). (ECF No. 60.) Farhan and John2 have filed counterclaims 20 for collection of debt and unjust enrichment. (ECF Nos. 96 & 98.) 21 Before the court is Farhan Malik’s motion for summary judgment (ECF No. 120); see 22 ECF Nos. 122 & 122-1 (evidence in support of motion). Plaintiffs have opposed the motion 23 (ECF No. 124), and Farhan has filed a reply (ECF No. 126). Also before the court is John 24 Malik’s motion for summary judgment (ECF No. 123).
