MARTINEZ, (Doc. 14) 15 Defendant. 16 17 The magistrate judge screened the first amended complaint and issued findings and 18 recommendations that this action be dismissed for failure to state a cognizable claim upon which 19 relief may be granted. (Doc. 14.) The Court served the findings and recommendations on 20 plaintiff and notified him that any objections were due within 14 days. (Id. at 7.) The Court also 21 informed Plaintiff that “failure to file objections within the specified time may result in the waiver 22 of the ‘right to challenge the magistrate’s factual findings’ on appeal.” (Id. at 8, quoting 23 Wilkerson v.
