(ECF No. 15) 14 BARBA, et al., 15 Defendants. 16 17 Plaintiff Desmond Pryer (“Plaintiff”) is a state prisoner proceeding pro se and in forma 18 pauperis in this civil rights action under 42 U.S.C. § 1983. On November 10, 2025, Plaintiff filed 19 a notice of voluntary dismissal pursuant to Federal Rule of Civil Procedure 41(a)(A)(i). (ECF 20 No. 15.) 21 “[U]nder Rule 41(a)(1)(i), a plaintiff has an absolute right to voluntarily dismiss his action 22 prior to service by the defendant of an answer or a motion for summary judgment.” Commercial 23 Space Mgmt. Co., Inc. v.
