18 19 This matter is before the court on defendant’s motion to dismiss the second amended 20 complaint (“SAC”) filed on behalf of plaintiffs Jon Persinger and his wife, Nicole Persinger and 21 defendant’s motion to strike portions of plaintiffs’ SAC. (Doc. No. 26.) On October 14, 2025, 22 defendant’s motion to dismiss was taken under submission pursuant to Local Rule 230(g). (Doc. 23 No. 29.)
