18 This matter is before the court on defendant’s motion to dismiss the second amended complaint (“SAC”) filed on behalf of plaintiffs Jon Persinger and his wife, Nicole Persinger and defendant’s motion to strike portions of plaintiffs’ SAC. (Doc. No. 26.) On October 14, 2025, defendant’s motion to dismiss was taken under submission pursuant to Local Rule 230(g). (Doc. No. 29.) For the reasons explained below, the court will grant defendant’s motion to dismiss the SAC and deny defendant’s motion to strike portions of plaintiffs’ SAC.
