15 Defendant. 16 17 Plaintiff Jerri Michele Moore seeks judicial review of a final decision by Defendant 18 Commissioner of Social Security denying an application for supplemental security 19 income.1 In the summary judgment motion, Plaintiff contends the final decision of the 20 Commissioner contains legal error and is not supported by substantial evidence. Plaintiff 21 seeks a finding of disability and an award of benefits. The Commissioner opposes 22 Plaintiff’s motion, filed a cross-motion for summary judgment, and seeks affirmance. 23 For the reasons below, Plaintiff’s motion is GRANTED, the Commissioner’s cross- 24 motion is DENIED, and the final decision of the Commissioner is REVERSED AND 25 REMANDED for further proceedings. 26 / / / 27 1 This action was referred to the magistrate judge under Local Rule…
