The motion was referred to the undersigned pursuant to 28 U.S.C. § 21 636(b)(1)(B) and Local Rule 302. Defendant did not file an opposition to the motion, and the 22 time in which to do so has passed. L.R. 230(c) (“Opposition . . . to the granting of the motion 23 shall be in writing and shall be filed and served no later than fourteen (14) days after the motion 24 was filed.”) 25
