I. INTRODUCTION

16 In this civil action filed on May 27, 2025, Plaintiff Travelers Property Casualty Company 17 of America seeks declaratory relief against Defendant James Jones regarding coverage under an 18 insurance policy. (ECF No. 1). Asserting that it cannot serve Defendant by conventional means, 19 Plaintiff has filed a motion for service on Defendant by publication. (ECF No. 9). 20 Upon review, the Court will permit Plaintiff to file a supplement in support its motion to 21 address the issues raised in this order. 22 II. LEGAL STANDARDS 23 Federal Rule of Civil Procedure 4(e)(1) permits service on an individual defendant by 24 “following state law for serving a summons in an action brought in courts of general jurisdiction 25 in the state where the district court is located or where service is made.” Here, Plaintiff requests 26 permission to serve Defendant under California Code of Civil Procedure § 415.50(a)(1), which 27 provides as follows: A summons may be served by publication if upon affidavit it appears to the 28 satisfaction of the court in which the action is pending that the party to be served 1 cannot with reasonable diligence…
