14 A. OBOYLE, et al. 15 Defendants. 16 17 Plaintiff is a state prisoner proceeding pro se with a civil rights action pursuant to 42 18 U.S.C. § 1983. Currently before the court is defendants’ motion for summary judgment.1 ECF 19 No. 28. 20 I. Procedural History 21 This case proceeds on plaintiff’s second amended complaint. ECF No. 13. On screening, 22 the court found that plaintiff had stated a cognizable deliberate indifference claim against 23 defendants O’Boyle and Rutledge and dismissed plaintiff’s retaliation claim without leave to 24 amend. ECF No. 14, 22. In response to the complaint, defendants filed an answer (ECF No. 27) 25 and an exhaustion-based motion for summary judgment (ECF No. 28).
