18 19 Plaintiff Michael Bruce Anthony McPherson is appearing pro se and in forma pauperis in 20 this civil rights action. This matter was referred to a United States magistrate judge pursuant to 21 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. 22 On September 29, 2025, plaintiff filed a motion for summary judgment. Doc. 12. On 23 October 21, 2025, the assigned magistrate judge issued findings and recommendations, 24 recommending that plaintiff’s motion for summary judgment be denied as premature.
