15 Defendant. 16 17 18 Plaintiff sought judicial review of a final decision of the Commissioner of Social Security 19 (“Commissioner”), denying her application for benefits under the Social Security Act. On 20 September 6, 2023, Magistrate Judge Deborah Barnes remanded this action to the Commissioner 21 for further proceedings. ECF No. 17. On remand, Plaintiff was awarded past benefits of 22 $113,451.95, plus ongoing benefits of $2,756 per month after July 2025. ECF No. 22-3 at 2. 23 Now pending before the court is Plaintiff’s Motion for an award of $28,000 in attorney’s 24 fees pursuant to 42 U.S.C. § 406(b). ECF No. 22. The Commissioner filed a statement that he 25 “neither supports nor opposes counsel’s request for attorney’s fees.” ECF No. 26 at 2.
