Jin, a girl born in China on April 28, 1941, filed an application with the Consul General at Hong Kong on May 6, 1952, for a passport or travel document to travel to the United States to join Tam Tong Gong, an American citizen she claimed to be her father. No action of any kind on her application was taken and it was ignored during a period of over seven months to December 22, 1952, when she filed her action under Section 503 of the Nationality Act of 1940. For the reasons stated in Dulles v. Fong, supra, we hold that the application for the passport or travel document was denied and that the court had jurisdiction to entertain her petition.
