BACKGROUND FACTS 3 On February 14, 1990, Lee filed a civil rights action against the Sheriff's Department and John Benedict, a sheriff's deputy. He alleged that the Sheriff's Department and Benedict deprived him of his constitutional rights by authorizing and assisting the towing of his mobile home on February 15, 1989.
