BACKGROUND
A. Administrative Proceedings Gautam Chaudhuri is a tenured professor of medicine and chair of the Department of Obstetrics and Gynecology at the
3 UCLA David Geffen School of Medicine. On May 13, 2013, the university’s Sexual Harassment and Title IX Officer notified Chaudhuri that it had received a report that he had sexually harassed E.B.,2 the woman who worked as his executive assistant from 2009 to 2013. The notice stated that the Vice Chancellor for Academic Personnel and the Academic Senate’s Charges Committee had asked for a fact-finding investigation regarding the allegations. It also informed Chaudhuri: “Retaliation is forbidden by law and University policy. Retaliation includes any adverse action that would discourage someone from making a good faith report of suspected discrimination. You must refrain from taking any retaliatory action.” The investigation was conducted by a company retained by the university. During the investigation, the investigator learned of an earlier complaint that had been filed against Chaudhuri.
