Background In November 2019, plaintiff filed a complaint alleging causes of action against for false imprisonment, intentional infliction of emotional distress, negligent infliction of emotional distress, and elder abuse. In August 2020, the court overruled defendants’ demurrer to the causes of action for false imprisonment and negligent infliction of emotional distress but sustained

In September 2020, plaintiff filed a first amended complaint (hereafter complaint) realleging the above causes of action. As relevant here, the complaint alleges that plaintiff was admitted as a patient at ValleyCare Medical Center (hereafter hospital) after being diagnosed with bacterial pneumonia causing congestive heart failure. Plaintiff’s treating doctor pierced plaintiff’s right femoral artery while performing an allegedly unwanted angiogram procedure.
