Recreational Use Statue 3 We review de novo the district court's grant of summary judgment. Darring v. Kincheloe, 783 F.2d 874, 876 (9th Cir.1986). We determine whether there are any genuine issues of material fact and whether the district court correctly applied the relevant substantive law. Id. 4 Todd argues that the district court erred in holding that the Washington Recreational Use Act granted the government immunity from negligence liability for Todd's fall on the stairway leading to the underwater viewing room at the McNary Dam.
