Defendant Jefferson Ernest Courts was charged with unlawful possession of a firearm and unlawful possession of ammunition. At trial, the prosecution developed an alternative factual theory of guilt on the ammunition offense that was not shown by evidence presented at the preliminary hearing, and that was supported by the testimony of a prosecution witness who did not testify at the preliminary hearing.
