After exhausting his state court remedies, he filed a petition for a writ of habeas corpus in the district court. The district court denied his petition and Marquez now appeals. We review the district court's denial of a habeas corpus petition de novo. Thomas v. Brewer, 923 F.2d 1361, 1364 (9th Cir.1991). We have jurisdiction under 28 U.S.C.
