Overview. 3 Melvin Albiso and Aurelio Casem, Jr., appeal the district court's directed verdict and summary judgments in favor of Los Angeles County deputy sheriffs ("the deputies") on their 42 U.S.C. Sec. 1983 claims alleging unlawful seizure and use of excessive force. We reverse the directed verdict and remand for retrial on the issue of excessive force against Albiso. We affirm the summary judgment on excessive force with respect to the deputies who did not come into physical contact with Albiso during the handcuffing procedure.…
