Mont.Code Ann. §§ 33-18-201, -242 (1991). Safeco removed the action to federal court on the basis of diversity of citizenship. Following trial, the jury returned a verdict for plaintiff of $35,894.85 compensatory damages and $250,000 punitive damages. The district court denied Safeco's post trial motions.
