In 2007, the victim was 14 years old. During a family gathering, defendant Carlos Victor Zaragoza, who was married to the victim’s cousin, suggested the victim accompany him to a convenience store. On the way, they stopped in a vacant lot. Defendant drank brandy and offered some to the victim. Defendant then forced the victim against a fence, kissed her, and digitally penetrated her vagina.
