BACKGROUND

1. Procedural history Defendant was charged in count 1 with making criminal threats to Anthony Jackson (Jackson) in violation of Penal Code section 4222 and charged in count 2 with making attempted criminal threats to Los Angeles County Deputy Sheriff Mike Barraza (Deputy Barraza) in violation of sections 664 and 422. The information alleged for purposes of section 667, subdivision (a)(1), that defendant had suffered a prior serious or violent felony conviction in 2005; and that defendant suffered a 2010 felony conviction for which he served a prison term within the meaning of section 667.5, subdivision (b). The trial court granted defendant’s pretrial Pitchess discovery motion, and after conducting an in camera review of the documents the court found no discoverable material.
