The Court provided Plaintiff with leave to amend to adequately allege a basis for the Court’s subject matter jurisdiction. Deitsch Plastics’ Third Amended Complaint alleges a single claim for breach of contract against defendant Gredale LLC (“Defendant” or “Gredale”). Gredale filed a Counterclaim alleging a single claim for breach of warranty. Prior to the Pretrial Conference, the parties stipulated to a Court Trial.
