INTRODUCTION Plaintiffs Merry Russitti Diaz and Kater Perez bring suit individually and on 19 behalf of a certified class under the Employee Retirement Income Security Act 20 (“ERISA”), 29 U.S.C. §§ 1001–1461, against Defendants Westco Chemicals, Inc.; 21 Alan Zwillinger; and Steven Zwillinger (all together, “Westco”) for harm arising from 22 Westco’s mismanagement of a defined benefit pension plan (“Plan”) in which 23 Plaintiffs were participants. Defendants now move for summary judgment. (Mot. 24 Summ. J. (“Motion” or “Mot.”), ECF No. 52.)
