In November 2022, the Court received from Plaintiff Broque Anthony Anderson (“Plaintiff”) a 42 U.S.C. § 1983 Complaint against Defendants (1) Upland Police Department (“UPD”), (2) UPD Officer Gabriel Santana; and (3) UPD Officer Lavena. (Dkt. 1.) Plaintiff alleges that he was sitting on a bench in the City of Upland eating lunch after work when Officer Lavena approached him with her gun drawn.
