INTRODUCTION Plaintiff Ding Chen brings suit against the Secretary of the Army, seeking an 20 upgrade of his discharge characterization and review of other findings of the Army 21 Board for Correction of Military Records pursuant to the Administrative Procedure 22 Act (“APA”), 5 U.S.C. §§ 701 et seq. On July 7, 2023, the Court held a hearing on the 23 matter, taking sworn testimony from Chen and hearing arguments from both sides on 24 Chen’s Motion for Summary Judgment, (Mot. Summ. J.
