Sean Ryan v. Justifacts Credential Verification, Inc.

I. Background

Plaintiffs Sean Ryan (“Plaintiff”) brought this lawsuit alleging that Defendant Justifacts Credential Verification (“Justifacts” or “Defendant”) furnished incorrect and harmful investigative consumer reports to third parties concerning Plaintiff. Complaint (Dkt. 1) ¶ 38. Plaintiffs filed a lawsuit in Orange Count Superior Court alleging four violations of California’s Investigative Consumer Reporting Agencies Act (“ICRAA”). See generally id. Defendant removed the case to this Court on August 22, 2023, asserting that this Court has diversity jurisdiction. See generally Notice of Removal (“Not.”) (Dkt. 1).

“If at any time before final judgment it appears that the district court lacks subject matter jurisdiction, the case shall be remanded.” 28 U.S.C. § 1447(c). Removal of a case from state court to federal court is governed by 28 U.S.C. § 1441, which provides in relevant part that “any civil action brought in a State court of which the district courts of the United States have original jurisdiction, may be removed . . . to the district…
