On October 5, 2023, petitioner Gabriel Ralphie Menchaca filed a Petition for Writ of Habeas Corpus by a Person in State Custody under 28 U.S.C. § 2241 which the Court reclassified as a § 2254 petition since petitioner appeared to be in state custody pursuant to a state court conviction.
