I. Introduction
On September 13, 2023, Brittney Ramirez (“Plaintiff”) brought this action against Indochino Apparel, Inc. (“Defendant”) and Does 1 through 25 in the Los Angeles Superior Court. Dkt 1-2. The Complaint advances two causes of action: (1) violation of the California Invasion of Privacy Act (“CIPA”), Cal. Penal Code § 631(a); and (2) violation the California Unauthorized Access to Computer Data Act (“CUCA”), Cal. Penal Code § 502(e). Id. ¶¶ 15–27. On October 13, 2023, Defendant removed this action based on diversity jurisdiction (the “Notice of Removal”). Dkt. 1. On November 17, 2023, Defendant filed a Motion to Dismiss the Complaint. Dkt. 17. Plaintiff opposed the MTD (the “MTD Opposition”). Dkt 20-1.1 On January 2, 2024, Plaintiff filed a Motion to Remand. Dkt. 19. Defendant opposed the MTR (the “MTR Opposition” (Dkt. 21)), and Plaintiff filed a reply (the “MTR Reply” (Dkt. 22)). A hearing on the Motions was conducted on February 5, 2024. For the reasons stated in this Order, the Motion to Remand is GRANTED. Because there is no federal jurisdiction, the Motion to Dismiss cannot be addressed.
