INTRODUCTION 1188 Plaintiff Firpo Wycoff Carr brings this action against Defendants Federal Bureau 1199 of Investigation (“FBI”) and the United States Department of Justice (“DOJ”) for claims 2200 under Bivens and the Federal Tort Claims Act (“FTCA”), arising out of an incident at a 2211 Panera Bread on November 26, 2022. (Second Am. Compl. (“SAC”), ECF No. 59.1) 2222 Defendants now move to dismiss this action pursuant to Federal Rules of Civil 2233 Procedure (“Rules”) 12(b)(1) and 12(b)(6). (Mot.
