Further, the Court has engaged in a de novo review of those portions of the Report to which objections have been made. The Amended Report and Recommendation (“Report”) recommends denial of the First Amended Petition and dismissal of this action with prejudice. (ECF No. 59.) As explained below, Petitioner’s objections to the Report (ECF No. 61) do not warrant a change to the Magistrate Judge’s findings or recommendation.
