14 Defendants. 15 16 17 This matter is before the Court on the Notice of Removal filed by Brian Lee Freeman 18 (“Freeman”) regarding Case No. FVI23000631 in the Superior Court for San Bernardino 19 County. (ECF No. 1). The Court takes judicial notice of the docket in Case No. 20 FVI23000631, which indicates that the case is a felony criminal case filed against Freeman. 21 For the reasons set forth below, the Court remands the case to the Superior Court for 22 the County of San Bernardino for lack of subject matter jurisdiction.1 23 Unless otherwise expressly provided by Congress, a defendant may remove “any 24 civil action brought in a State court of which the district courts of the United States have 25 original jurisdiction.” 28 U.S.C. § 1441(a) (emphasis added).
