CDCR DVI, Defendant. 15 Plaintiff is a state prisoner proceeding pro se with a civil rights action pursuant to 42 U.S.C. § 1983. By order dated March 21, 2019, plaintiff’s first amended complaint was screened and dismissed for failure to state a claim. (ECF No. 12.) Plaintiff was directed to file an amended complaint within thirty days and warned that failure to file an amended complaint would result in a recommendation that this action be dismissed. Thereafter, plaintiff filed a motion for an extension of time to file an amended complaint. (ECF No. 17.) The court granted plaintiff additional time in which to file an amended complaint.
