15 Defendant. 16 Plaintiff is a former county and current state prisoner proceeding pro se with a civil rights action pursuant to 42 U.S.C. § 1983 and Title II of the Americans with Disabilities Act (ADA), 42 U.S.C. § 12132. Currently before the court is defendant’s fully briefed motion to dismiss plaintiff’s third amended complaint (ECF No. 31) and plaintiff’s motions for a subpoena (ECF No. 36), to compel discovery (ECF No. 37), and to proceed (ECF No. 39).
