Pending is a motion to dismiss the operative Second Amended Complaint (“SAC”) by Lara Saich, Janet Lewis, Christine Milne, and Glen Welker (“individual state defendants”). ECF No. 31-1 at 7. Plaintiff has opposed the motion (ECF No. 35) and defendants replied (ECF No. 37). For the reasons explained below, the undersigned recommends the motion to dismiss be GRANTED. I.
