14 Patrick Garcia (“Plaintiff”) filed this action against Praxair, Inc. (“Praxair” or “Defendant”) pursuant to 28 U.S.C. § 1332(a). Currently before the Court is Defendant’s motion for partial summary judgment filed November 15, 2019. The Court heard oral argument on December 18, 2019. Counsel Tom Duckworth and Dena Narbaitz appeared for Plaintiff, and counsel Jason Borchers appeared telephonically for Defendant.
