17 Plaintiff Christopher Allen Van Gessel is a federal prisoner proceeding pro se and in forma pauperis with this civil rights action brought pursuant to the decision in Bivens v. Six Unknown Named Agents of Federal Bureau of Narcotics, 403 U.S. 388 (1971). The matter was referred to a United States Magistrate Judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. On October 29, 2019, the assigned magistrate judge issued findings and recommendations, recommending that plaintiff’s motion for preliminary injunctive relief (Doc. No. 9) be denied. (Doc. No. 13.) Specifically, the magistrate judge found that the court lacks jurisdiction to issue the order sought by plaintiff. …
