Pending before the undersigned are defendants’ motions to dismiss the amended complaint pursuant to Rule 12(b)(6) and Rule 12(e) of the Federal Rules of Civil Procedure. (ECF Nos. 25 & 26.) For the reasons stated below, the undersigned will recommend that defendants’ motions to dismiss be granted and that plaintiff’s amended complaint be dismissed without leave to amend.
