Opinion
Trial Court Opinion
UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF CALIFORNIA 10 LIFALFA GREEN, No. 2:19-cv-0538-EFB P Plaintiff, v. ORDER AND FINDINGS AND
RECOMMENDATIONS
MARY BATCHELOR, et al., Defendants. 16 Plaintiff is a state prisoner proceeding pro se and in forma pauperis in an action brought under 42 U.S.C. § 1983. On March 10, 2020, the court determined that plaintiff’s complaint had alleged, for screening purposes, a viable First Amendment retaliation claim against defendant Batchelor, but had not alleged any viable claims against defendants Myers, Difuntorum, Bayoneta, August, or Moreno. ECF No. 12. The court informed plaintiff he could proceed with the claim against defendant Batchelor or file an amended complaint within 30 days. Id. Plaintiff has elected to proceed only with the claim against defendant Batchelor. See ECF No. 15. Accordingly, IT IS ORDERED that the Clerk of the Court shall randomly assign a United States District Judge to this case. ///// ///// 28 1 …
