14 MICHAEL PALLARES, Acting Warden, 15 Respondent. 16 17 Petitioner, a state prisoner proceeding pro se, has filed a petition for writ of habeas corpus 18 pursuant to 28 U.S.C. §2254. The matter was referred to the United States Magistrate Judge 19 pursuant to 28 U.S.C. §636(b)(1) and Local Rule 302(c). 20 On July 3, 2020, petitioner filed a petition for writ of habeas corpus. ECF No. 1. On 21 August 7, 2020, the court granted petitioner thirty days to file a motion for stay and abeyance 22 pursuant to Rhines v. Weber, 544 U.S. 269 (2005) based on a failure to exhaust state court 23 remedies. ECF No. 3. Petitioner was further “warned that failure to file a motion for stay and 24 abeyance within the court’s deadline will result in a recommendation that this action be dismissed 25 as unexhausted.
