16 17 The Court screened Plaintiff’s complaint and found it lacked a cognizable claim. The Court 18 directed Plaintiff to submit a notice indicating whether he wished to proceed with the complaint as 19 screened, whether he wished to file a new pleading, or whether he wished to dismiss this action. 20 The Court warned Plaintiff that his failure to comply would result in the recommendation that the 21 action be dismissed for failure to obey a court order and failure to state a claim. The deadline for 22 responding to the Court’s order has now passed, and plaintiff has not submitted his notice or an 23 amended pleading, and the time for he has not requested an extension of time to do so.
