ORDER 14 ACHARYA, et al., 15 Defendants. 16 17 Plaintiff, a state prisoner at the California Health Care Facility, proceeds pro se with a 18 civil rights complaint filed pursuant to 42 U.S.C. § 1983. Plaintiff has filed a motion to compel 19 discovery and motion for an extension of time, (ECF No. 60; ECF No. 62) and defendants have 20 filed motions to modify the discovery and scheduling orders. (ECF No. 61, 66.) 21 I. Motion to Compel 22 The scope of discovery under Federal Rule of Civil Procedure 26(b)(1) is broad. 23 Discovery may be obtained as to “any nonprivileged matter that is relevant to any party’s claim or 24 defense and proportional to the needs of the case.” Fed. R. Civ. P. 26(b)(1). “Information within 25 this scope of discovery need not be admissible in evidence to be discoverable.” Id. The court, 26 however, may limit discovery if it is “unreasonably cumulative or…
