WILLOX, et al., 14 Defendants. 15 16 Plaintiff, a state prisoner proceeding pro se with a civil rights action, has requested 17 appointment of counsel. Plaintiff appears to be requesting relief from the Ninth Circuit regarding 18 an appeal of the judgment in the instant action. ECF No. 69. Plaintiff previously requested and 19 received an extension of time to file a notice of appeal, (ECF Nos. 67 & 68), but has not yet filed 20 a notice of appeal. 21 The United States Supreme Court has ruled that district courts lack authority to require 22 counsel to represent indigent prisoners in § 1983 cases. Mallard v. United States Dist. Court, 490 23 U.S. 296, 298 (1989). In certain exceptional circumstances, the district court may request the 24 voluntary assistance of counsel pursuant to 28 U.S.C. § 1915(e)(1). Terrell v.
