14 C. HEARN, et al., 15 Defendants. 16 17 I. Introduction 18 Plaintiff is a state prisoner, proceeding without counsel, with a civil rights action pursuant 19 to 42 U.S.C. § 1983. This action proceeds on claims against defendants Parham, Hearn and 20 Erickson. 21 Pending before the court is defendants’ March 10, 2020 motion for partial summary 22 judgment on the grounds that plaintiff failed to administratively exhaust all of his claims against 23 defendant Parham and all but one of his claims against defendant Hearn. (ECF No. 31.) 24 Defendants’ motion for partial summary judgment does not address plaintiff’s claims against 25 defendant Erickson. 26 For the reasons stated herein, the undersigned recommends that defendants’ motion be 27 granted in part and denied in part. 28 1 II.
