ORDER 14 ALTA REGIONAL CENTER, 15 Defendant. 16 17 Plaintiff is proceeding in this action pro se. This action was referred to this court by Local 18 Rule 302(c)(21). Plaintiff has requested permission to proceed in forma pauperis under 28 U.S.C. 19 § 1915. 20 Plaintiff has submitted the affidavit required by section 1915(a) showing that he is unable 21 to prepay fees and costs or give security for them. (ECF No. 2.) Accordingly, plaintiff’s request 22 to proceed in forma pauperis will be granted. 28 U.S.C. § 1915(a). 23 The federal in forma pauperis statute authorizes federal courts to dismiss a case if the 24 action is legally “frivolous or malicious,” fails to state a claim upon which relief may be granted, 25 or seeks monetary relief from a defendant who is immune from such relief. 28 U.S.C. 26 § 1915(e)(2). 27 A claim is legally frivolous when it lacks an arguable basis…
