Plaintiff alleges defendant was deliberately indifferent to his serious medical needs in violation of the Eighth Amendment. In an order and findings and recommendations filed October 15, 2020, this court recommended defendant’s motion for summary judgment be granted on the grounds that plaintiff failed to exhaust his administrative remedies prior to filing this suit. In addition, this court addressed a motion to compel plaintiff appended to his opposition to the summary judgment motion. This court denied the motion to compel defendant to further respond to requests for admissions and requests for the production of documents. (ECF No. 55.)
